Fulton County District Attorney Fani Willis has charged former President Donald Trump and 18 others with participating in schemes to meddle with Georgia’s 2020 election results.

All 19 co-defendants must surrender ahead of a noon Friday deadline set by Willis when she unveiled last week’s sweeping indictment over attempts to overturn Trump’s 2020 election loss to Joe Biden.

Brian Tevis, an attorney representing Rudy Giuliani in Georgia, told CNN that it is “very premature to be saying what is the defense going to be” when asked if Giuliani would be using his status as a lawyer for former president Donald Trump as a defense in the Georgia election subversion case.

Tevis, a Georgia attorney who represented Giuliani in bond and surrender negotiations with the Fulton County district attorney’s office, said he does not know if he will continue to represent the former mayor in the case.

When Collins asked Tevis if Giuliani is paying him for his work, he responded, “I don’t want to get into any attorney-client privilege or discussions about things that my client and I have discussed.”

He added, “I don’t discuss my clients’ finances or arrangements between us in any of my cases and this one’s no different.”

Tevis said he did not know who paid for the private plane that Giuliani flew on to Georgia Wednesday.

Fulton County District Attorney Fani Willis said Mark Meadows’ attempt to move her election subversion case to federal court should be rejected because the conduct in question was “political activity” outside of his official duties as former President Donald Trump’s White House chief of staff.

Willis sought to counter Meadows’ claim, made as part of his effort to move the charges against him to federal court, that he is immune from the state prosecution because the indictment targets conduct he was doing as an agent of the federal government.

Her office argued that the episodes involving him that were highlighted in last week’s grand jury indictment fit a pattern of him and other Trump White House officials ignoring a federal law, known as the Hatch Act, that prohibits the use of one’s federal office to engage in political activity.

Meadows’ “lack of care for the lawful scope of his official duties is a matter of record,” the district attorney told the court, and she said Meadows’ own court filings in the removal dispute “makes no mention of the fact that every single one of the activities giving rise to his indictment constitutes impermissible political activity which a Chief of Staff may not lawfully perform ‘under color of office.’”

Willis’ filing, which was submitted ahead of a Monday hearing in Atlanta before US District Judge Steve Jones, is a preview of how she could fight against a similar effort by Trump, who is also expected to seek that the state court proceedings be moved to federal court.

It also hints at the evidence she is assembling for Monday’s hearing, with references to House January 6 committee depositions given by top Trump White House aides who witnessed episodes involving Meadows that Willis contends were overt acts of the alleged RICO conspiracy.

Her office has also issued subpoenas for testimony at Monday’s hearing to two lawyers who were present on the Trump call with Georgia Secretary of State Brad Raffensperger, which is central to the allegations Fulton County prosecutors are making against the former White House chief of staff.

Judge rejects former White House chief of staff Mark Meadows' request to avoid arrest

A federal judge has rejected a bid by former White House chief of staff Mark Meadows to block Fulton County District Attorney Fani Willis from arresting him if he fails to turn himself in by the Friday noon deadline.

US District Judge Steve Jones declined the emergency request by Meadows, who argued he should be allowed to avoid processing in the election subversion case ahead of a hearing scheduled Monday in his effort to move the charges against him to federal court.

Jones wrote that “the clear statutory language for removing a criminal prosecution, does not support an injunction or temporary stay prohibiting District Attorney Willis’s enforcement or execution of the arrest warrant against Meadows.”

The broader efforts by Meadows and former Justice Department official Jeffrey Clark to move their cases to federal court will continue.

Former Trump campaign lawyer Jenna Ellis, who was indicted in the Georgia election subversion case, has surrendered at the Fulton County jail in Atlanta.

District Attorney Fani Willis charged Ellis last week with two state crimes: violating Georgia’s anti-racketeering law and soliciting a public officer to violate their oath.

Ellis planned hearings in 2020 before Georgia lawmakers where she and other Donald Trump allies pushed baseless fraud claims. She alsowrotelegal memos arguing Pence could block Joe Biden’s victory from being certified by Congress on January 6, 2021, though that isn’t part of the charges.

Rudy Giuliani was treated and processed like “everybody else” who is booked at the local jail — a process that includes fingerprints and mugshots being taken, Fulton County Sheriff Pat Labat told CNN.

The arrest, booking and release of Giuliani took less than an hour.

CNN previously reported that defendants in the election subversion case have been quickly ushered through the process, which typically stretches for multiple hours.

A total of 19 defendants in this case are facing charges stemming from efforts to overturn the 2020 presidential election results in Georgia.

When asked if the booking process was expedited for Giuliani, Labat said it was the “same process as all 19.”

Several defendants, including former President Donald Trump, have yet to turn themselves in. They have until noon ET on Friday to do so.

After emerging from jail, Giuliani told reporters: “I am very, very honored to be involved in this case because this case is a fight for our way of life.”

He went on to say that Fulton County District Attorney Fani Willis “will go down in American history as having conducted one of the worst attacks on the American Constitution ever when this case is dismissed.”

Giuliani visited a bail bonds agent afterward.

Ken Chesebro, the pro-Trump lawyer who devised the “fake electors” scheme, asked a Georgia judge Wednesday to throw out the charges against him in the Fulton County election subversion case.

Motions like these are common at the start of a criminal case, and they are rarely successful.

The request came in procedural filing where Chesebro asserted many of the rights he has a criminal defendant – like the right to a speedy trial, and to receive “discovery” evidence from prosecutors.

Chesebro’s attorney said the indictment “fails to sufficiently set out the charge or any violation of the law” and lacks other essential details that are needed to move forward – and thus should be tossed.

The filing also asks Fulton County Superior Court Judge Scott McAfee to schedule a hearing so he can scrutinize what evidence the prosecutors will need to turn over as part of the discovery process.

Fulton County District Attorney Fani Willis told a federal court that it should not interfere in any efforts to arrest Mark Meadows, should the former White House chief of staff fail to turn himself in by Friday’s noon deadline.

In a court filing Wednesday, Willis called Meadows’ request for a federal court to intervene “improper” and “baseless.”

Both Meadows and Jeffrey Clark are seeking to move the state court criminal case against them to federal court, where they argue that the charges against them should be dismissed.

Meadows, former President Donald Trump’s White House chief of staff, faces two charges in the Fulton County grand jury indictment, which alleges that his participation on the January 2021 Trump call with Georgia Secretary of State Brad Raffensperger was unlawful. Clark faces two charges stemming from his alleged efforts as a then-Justice Department official to aid Trump’s election reversal plots.

US District Judge Steve Jones, who has been assigned both the Meadows and Clark matters, has indicated he wants to act quicklyin response to the emergency orders that would allow Meadows and Clark to avoid arrest. Now that Willis has responded, Jones may act at any time.

Sidney Powell surrenders at Fulton County jail

Sidney Powell, one of former President Donald Trump’s election lawyers, turned herself in to the Fulton County jail this afternoon to be booked.

Powell had struck a $100,000 bail agreement with prosecutors.

She will be subject to the same standard release conditions as her co-defendants in the Georgia election subversion case, including prohibitions on committing additional crimes or contacting witnesses.

Powell promoted baseless theories about voter fraud. She was also at a White House meeting with Trump in December 2020 where there was a discussion of appointing her as a special counsel to “investigate allegations of voter fraud in Georgia and elsewhere,” according to the indictment.

Rudy Giuliani has reached a bond agreement with prosecutors in the Fulton County election subversion case.

The former New York mayor has agreed to a $150,000 bond. As part of the bond order negotiated Wednesday between Giuliani’s attorneys and Fulton County District Attorney Fani Willis’ office, Giuliani agreed to follow other rules that have similarly been imposed on his co-defendants in the case, including not talking about the case with co-defendants and witnesses except through counsel.

Inthe indictment handed up last week, Giuliani, who worked as one of former President Donald Trump’s most outspoken attorneys in 2020, was charged with 13 crimes, including breaking the state’s racketeering act, engaging in various criminal conspiracies, and soliciting a public officer in the state to violate their oath.

Upon landing in Atlanta, Rudy Giuliani is expected to meet with his attorneys at a local law office before a meeting with the district attorney’s office to discuss terms of a bond agreement, CNN has learned.

CNN reporters saw Giuliani’s attorneys enter a local law office after touching down in Atlanta.

It is not clear if Giuliani himself will attend a meeting later today with prosecutors at the Fulton County courthouse complex, but he is expected to surrender once a bond agreement is reached, as CNN reported earlier Wednesday.

Former Coffee County elections supervisor Misty Hampton has reached a $10,000 bail agreement with prosecutors, according to court filings.

The agreement mirrors the bond packages many other defendants have secured in the election subversion case in Georgia, and it requires that Hampton turn herself in to the Fulton County jail by noon Friday.

In District Attorney Fani Willis’ case against Donald Trump and his allies, Hampton faces seven charges stemming from allegations that she facilitated a breach in Coffee County voter systems by the former president’s supporters.

The Fulton County election subversion case marks the first time release conditions for Donald Trump have included a cash bond and a prohibition on intimidation through social media.

The criminal case is the fourth brought against the former president this year.

In the previous cases, the conditions for Trump’s release after arrest and pending trial have been largely routine:

  • In Florida: In the Mar-a-Lago documents case brought against him by special counsel Jack Smith, Trump was released on personal recognizance, though there was some pushback from his attorneys on the restrictions that were imposed on his contact with witnesses in that case.
  • In Washington, DC: Trump also was released on minimal conditions in Smith’s federal election subversion case brought in Washington, DC. Those conditions include not being allowed to communicate with anyone known to be a witness in the case unless through an attorney.
  • In New York: And in the New York hush money case, Trump was similarly ordered to not communicate about the case with anyone central to it except through one of his attorneys.

The timing for former President Donald Trump’s processing at the Fulton County jail was a product of negotiations between his legal team and law enforcement, among others, all seeking to get the former president in and out as quickly as possible and without shutting down the entire city of Atlanta, according to multiple sources familiar with the conversations.

District Attorney Fani Willis has until 3 p.m. ET today to file court submissions responding to requests by Mark Meadows and Jeffrey Clark – both defendants in her election subversion case against former President Donald Trump and several of his associates – that they be allowed to avoid arrest in her prosecution.

The dispute is playing out in federal court in Atlanta. Both Meadows and Clark are seeking to move the state court criminal case against them to federal court, where they argue that the charges against them should be dismissed. As part of that effort, they each filed requests for emergency court orders that would prevent Willis from seeking their arrest if they did not turn themselves in by the Friday noon deadline for self-surrender that Willis has set for the defendants in the case.

Meadows, who has a hearing scheduled for Monday in his effort to move the proceedings, had asked for Willis to extend the deadline for turning himself in until at least next week, after the hearing, according to court filings. But she rejected that request, writing in an email to his attorneys that come 12:30 p.m. ET Friday, she would file a warrant in the system for him if he had not self-surrendered.

Jones indicated he would not be accepting additional filings from Meadows and Clark responding to the arguments Willis makes in her submissions – a sign that the judge intends to issue his decisionssoon after the Willis filings come in.

Some context: Both Meadows and Clark are arguing that the alleged conduct for which they are being charged in the case was conducted to their roles as federal officials at the time, and therefore, the charges should be dismissed under a federal law giving certain immunity to people prosecuted for activities done on behalf of the US government.

The plane believed to be carrying former President Donald Trump’s co-defendant and ex-attorney Rudy Giuliani has landed at Atlanta’s Dekalb-Peachtree Airport.

Giuliani had said he is traveling to Atlanta to meet with prosecutors and surrender on charges that he conspired to subvert the 2020 presidential election in Georgia.

The former New York City mayor was seen exiting a private plane and entering a vehicle.

Giuliani has said his legal quagmires have left him effectively out of cash. He even appears to have responded to some of the money crunch by listing for sale a three-bedroom Manhattan apartment he owns for $6.5 million.

Not including standard legal fees, Giuliani faces nearly $90,000 in sanctions from a judge in a defamation case, a $20,000 monthly fee to a company to host his electronic records, $15,000 or more for a search of his records, and even a $57,000 judgment against his company for unpaid phone bills.

Trump election lawyer Sidney Powell strikes $100,000 bail agreement in Georgia

Sidney Powell struck a $100,000 bail agreement with prosecutors Wednesday morning, according to court documents.

She will be subject to the same standard release conditions as her co-defendants in the Georgia election subversion case, including prohibitions on committing additional crimes or contacting witnesses.

Powell has not yet turned herself in to authorities in Georgia, and the bond agreement specifies that she must surrenderbynoon on Friday.

Powell was one of Trump’s election lawyers, and promoted baseless theories about voter fraud. She was also at a White House meeting with Trump in December 2020 where there was a discussion of appointing her as a special counsel to “investigate allegations of voter fraud in Georgia and elsewhere,” according to the indictment.

CNN previously reported that Powell approved payment to a cyber forensics firm to examine voting systems in Coffee County, Georgia.

Powell’s alleged role in the voting systems breach, including payment to the firm, was cited throughout Fulton County District Attorney Fani Willis’ indictment.

The co-defendants in former President Donald Trump’s Georgia election subversion case who have turned themselves in to local authorities have been quickly ushered through a process that can sometimes stretch for hours or even days.

So far, four defendants have surrendered in the case against Trump and 18 co-defendants over efforts to overturn the 2020 presidential election results in the state.

Defense attorneys tell CNN they have gone through an expedited process – including having fingerprints and mugshots taken – in about an hour to an hour and 15 minutes.

Part of the reason the process is moving swiftly is because these defendants have already negotiated a bond agreement with prosecutors, so they don’t have to appear before a magistrate judge. Trump has already negotiated a $200,000 bond and his release conditions, and the former president is expected to turn himself in on Thursday.

While Chadha Jimenez said the defendants are getting “preferential treatment,” he said he’s not surprised because of their high profile.Chadha Jimenez, who is involved in another high-profile RICO case involving YSL rapper Young Thug, said Fulton County Sheriff Pat Labat, who oversees operations at the Fulton County jail, has treated other public figures in a similar fashion.

High-profile defendants can have their own security concerns, and their mere presence in the jail could bea disruption and a security concern for everyone at the jail, Chadha Jimenez said, adding that the quick booking process in the election subversion case “is for safety, not because they are rich and powerful.”

Several Trump co-defendants expected to surrender to Fulton County jail today, sources tell CNN

Rudy Giuliani and several other co-defendants of former President Donald Trump are expected to surrender to Fulton County jail on Wednesday, multiple sources tell CNN.

Altogether, only four of the 18 co-defendants have been booked as of Wednesday morning — two of them turned themselves in overnight.

Trump is expected surrender on Thursday.

District Attorney Fani Willis continues to meet with defendants and negotiate terms of a bond agreement. Her office is slated to meet with Giuliani on Wednesday, CNN has reported.

Others who have already negotiated bond, like former Trump aide Mike Roman, are expected to surrender as early asWednesday afternoon, according to a source familiar with the matter.

Kenneth Chesebro — the architect of the Trump campaign’s fake electors plot, who was charged in the Georgia election subversion case — has surrendered at the Fulton County jail in Atlanta.

District Attorney Fani Willis charged Chesebro last week with seven state crimes, including violating Georgia’s anti-racketeering law, conspiracy to commit forgery, and conspiracy to file false documents.

Chesebro was the legal architect of the multi-state plot to put forwardfake slates of pro-Trump electorsin Georgia and other states. Chesebro and other allies of former President Donald Trump hoped then-Vice President Mike Pence would delay Congress from certifying Biden’s victory —or even possibly recognize the fake GOP electors while rejecting Biden’s lawful electors on January 6.

After the indictment was announced, Chesebro’s attorney Scott Grubman said in a statement that “Mr. Chesebro did not once step foot in the State of Georgia on behalf of the campaign” and that he “stands ready to defend himself against these unfounded charges.”

CNN recently revealed for the first time thatChesebro was at the US Capitolduring the insurrection on January 6, 2021. He was on restricted grounds but did not breach the building and was not violent.

Former Trump campaign lawyer Ray Smith has surrendered at the Fulton County jail.

Smith is charged with 12 crimes, including violating Georgia’s anti-racketeering law, soliciting a public officer to violate their oath and conspiring to commit forgery.

Documents made public Tuesdayconfirmedthat Smith was in the room in December 2020 when the pro-Trump fake electors met in Atlanta.

Smith participated in a Georgia Senate hearing in December 2020 where he falsely alleged widespread fraud and voting irregularities and argued that the results “must be vacated and cannot be allowed to stand.” In the indictment, prosecutors allege that Smith made false statements at that hearing about illegal voting by felons and dead people.

The Fulton County Sheriff’s Office on Wednesday released the official booking reports for the first two defendants who surrendered in the Georgia election subversion case.

The bare-bones reports for the ex-attorney for former President Donald Trump, John Eastman, and bail bondsman Scott Hall don’t provide that much information beyond what was already previously available on the jail’s website.

Eastman’s booking report says he weighs 160 pounds and is 5 feet and 7 inches tall, with brown eyes and no tattoos or other identifiable markings. He was released after his surrender on Tuesday.

Hall’s booking report says he weighs 235 pounds and is 6 feet tall, with hazel eyes. The report indicates that he has a tattoo on his ankle. Like Eastman and all the other defendants so far, Hall was released after his surrender, in accordance with his pre-arranged bond agreement with prosecutors.

CNN obtained the booking reports through a Georgia open records request.

Trump will travel to Georgia for his surrender Thursday evening, according to a source familiar

Former President Donald Trump is expected to travel to Georgia for his surrender at the Fulton County jail Thursday evening, sources familiar with plans tell CNN.

Trump will leave his Bedminster golf club in in the afternoon, and return to New Jersey following his surrender. There are no expected events at his club upon his return. His team expects that it will be a quick trip.

Trump’s team has also been making arrangements for him to speak to the reporters traveling with him in Georgia, the sources said, though the former president may ultimately choose not to do so.

Trump was expected to take questions from reporters after he was arraigned in Washington, DC, earlier this month, but did not do so.

Former President Donald Trump’s ex-lawyer Rudy Giuliani departed his New York residence Wednesday, saying he is heading to Georgia and feeling “very good” about it.

“I’m going to Fulton County to comply with the law which I always do. I don’t know if I plead today but if I do, i’ll plead not guilty,” he added.

This comes as multiple sources say the former New York City mayor is planning to negotiate bond and surrender Wednesday — all in one day — unlike most other defendants who have spread the process across two or more days.

Speaking outside his New York City apartment early Wednesday, he said Trump is just a man who has been proven innocent many times.

“I don’t know how many times he has to be proven innocent and they have to be proven to be liars,” he said.

Former Georgia GOP chairman David Shafer, who was charged in the state-level election subversion case, surrendered overnight Wednesday at the Fulton County jail, according to county inmate records.

District Attorney Fani Willis charged Shafer last week with eight state crimes, including violating Georgia’s anti-racketeering law, forgery, and impersonating a public officer.

Shafer played a key role in organizing the Trump campaign’s slate of fake electors in Georgia, as part of the effort to subvert the Electoral College. He convened the 16 fake electors in the Georgia State Capitol in December 2020, where they signed a certificate falsely proclaiming that Trump won the state.

He also served as one of the 16 fake electors and was previously a Georgia state senator for 17 years.

After the indictment was announced, Shafer’s attorney Craig Gillen said he was “totally innocent of the charges” and that his actions in 2020 were “lawful, appropriate and specifically authorized by the U.S. Constitution, federal and state law and long-standing legal precedent.”

Cathy Latham, who faces charges in the Georgia 2020 election meddling case related to both the fake electors plot and Coffee County voter data breach scheme, surrendered overnight Wednesday at the Fulton County jail, according to county inmate records.

Latham is the former chair of the Coffee County Republican Party. She is one of 16 individuals who signed on to be alternative electors for former President Donald Trump to rival the legitimate electors of President Joe Biden, leading to several charges in District Attorney Fani Willis’ case.

Latham also faces conspiracy counts related to an alleged plot to unlawfully access voter data and ballot county equipment in Coffee County, in addition to the racketeering charge that is central to Willis’ case.

Latham has said she was not “personally involved” in the breach.

Donald Trump is expected to surrender at the Fulton County Jail on Thursday in the Georgia 2020 election subversion case – and when he does the former president will have three different options to pay the $200,000 bond that will keep him from being detained in the facility as his case unfolds.

District Attorney Fani Willis has given the defendants until noon Friday to surrender at the jail and a number of them have negotiated so-called bond orders with her office to ensure a speedy surrender process.

As of Wednesday morning, just four of the defendants had surrendered.

Here’s what to know about paying a bond in Fulton County and three different ways to do so to avoid being detained:

  • The first is with cash, which would require the amount to be paid in full at the jail.
  • The second way is through “commercial surety,” in which a defendant would use a professional bonding company. The Fulton County Sheriff’s Office publishes an “approved bonding list” for companies it works with. If a defendant goes with this option, the company doesn’t actually pay any money to the county, but the defendant would have to pay a fee to the company for using their services.
  • The third option is the “Fulton County Jail 10% program,” which allows a defendant to pay just 10% of their total bond amount — plus fees and other associated costs.

Trump election attorney John Eastman, who surrendered on Tuesday, went with the 10% option, as did Scott Hall, a professional bondsman in Atlanta, who was charged in the case with crimes related to his alleged involvement in the Coffee County, Georgia, voting systems breach

The consent bond orders being negotiated between the defendants’ attorneys and Willis spell out the conduct a defendant is prohibited from engaging in and specifies the amount of money they have to pay for each count brought against them in the case.

For Trump, who was charged with 13 crimes in the case, his $200,000 includes $80,000 for allegedly violating Georgia’s racketeering act and $10,000 for each of the remaining 12 counts brought against him.

Unlike some of his co-defendants, the former president is explicitly barred in his order from using social media to target his 18 co-defendants in the case, as well as any witnesses and the 30 unindicted co-conspirators.

The Fulton County election subversion case marks the first time the release conditions for Trump have included a cash bond and a prohibition on intimidation through social media.

An Atlanta-based grand juryindicted former President Donald Trumpand 18 co-defendants on state charges last week stemming from their efforts to overturn the former president’s 2020 electoral defeat in the Peach State.

All of the defendants have until noon ET Friday to voluntarily surrender to authorities, Fulton County District Attorney Fani Willis said.

Trump said he will turn himself in at the Fulton County jail on Thursday.
